Acceptance of Terms

Welcome to AAA Abatement LLC. These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and AAA Abatement LLC ("Company," "we," "us," or "our") governing your use of our website and services.

By accessing our website, requesting a quote, or engaging our services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

Important Notice

These Terms apply to all services provided by AAA Abatement LLC, including but not limited to lead abatement, asbestos abatement, inspections, testing coordination, and related environmental remediation services.

Service Description

AAA Abatement LLC is a professional environmental remediation contractor specializing in the safe removal and abatement of hazardous materials. Our services include:

  • Lead Paint Abatement: Professional removal, encapsulation, and remediation of lead-based paint in residential and commercial properties
  • Asbestos Abatement: Safe removal and disposal of asbestos-containing materials in accordance with federal, state, and local regulations
  • Lead & Asbestos Inspections: Coordination with licensed inspectors and industrial hygienists for testing and assessment
  • Clearance Testing Coordination: Arrangement of post-abatement clearance testing by independent third-party laboratories
  • Compliance Documentation: Complete documentation packages for regulatory compliance and property records
  • Emergency Response: Rapid response services for hazardous material emergencies (availability varies)

Services are provided within our licensed service area: Massachusetts, Connecticut, New Hampshire, and Vermont.

Quotes & Estimates

We provide written quotes and estimates for all proposed work. Please understand the following regarding our quotes:

Quote Validity

  • Quotes are valid for 30 days from the date of issuance unless otherwise specified
  • Quotes are based on information provided by the client and conditions observed during site assessment
  • Quotes may be adjusted if actual conditions differ from initial assessment
Estimate Disclaimer

All quotes and estimates are provided in good faith based on available information. However, hazardous material abatement often involves conditions not visible until work begins. We reserve the right to adjust pricing if hidden conditions, additional contamination, or unforeseen circumstances are discovered that materially affect the scope of work.

Factors That May Affect Final Cost

  • Discovery of additional contamination or hazardous materials
  • Structural conditions requiring additional containment or safety measures
  • Changes in disposal requirements or regulations
  • Client-requested changes to scope of work
  • Access limitations or delays not caused by our company
  • Emergency or expedited service requests

Scheduling & Site Access

Successful project completion requires proper scheduling and site access. The following terms apply:

  • Scheduling: Project start dates are confirmed upon receipt of signed contract and any required deposit
  • Site Access: Client must provide clear, unobstructed access to all work areas during scheduled work hours
  • Utilities: Client must ensure water and electricity are available at the work site
  • Occupancy: Work areas must be unoccupied during abatement work as required by regulations
  • Pets & Personal Property: Client is responsible for relocating pets, vehicles, and personal property from work areas

Delays

We are not responsible for delays caused by:

  • Client unavailability or failure to provide site access
  • Weather conditions that prevent safe work
  • Permit delays from government agencies
  • Force majeure events (natural disasters, pandemics, etc.)
  • Discovery of conditions requiring additional regulatory approvals

Cancellation Policy

We understand that circumstances change. Our cancellation policy is designed to be fair while protecting our business operations:

  • 7+ Days Notice: Full refund of any deposit paid, minus non-recoverable expenses (permits, material orders, etc.)
  • 3-6 Days Notice: 50% of deposit may be retained to cover scheduling costs and lost opportunity
  • Less than 3 Days Notice: Full deposit may be retained; additional charges may apply for mobilization costs already incurred
  • No-Show / Same Day Cancellation: Full deposit retained plus charges for any expenses incurred

Cancellations must be communicated in writing (email or text message accepted). The date of written notice determines the applicable cancellation terms.

Rescheduling

We make every effort to accommodate rescheduling requests. Rescheduling within 30 days typically does not incur additional fees, subject to crew availability. Repeated rescheduling may be treated as cancellation at our discretion.

Payment Terms

Payment terms are specified in individual project contracts. General payment terms include:

Standard Payment Structure

  • Deposit: 30-50% deposit required upon contract signing (varies by project size)
  • Progress Payments: For larger projects, progress payments may be required at specified milestones
  • Final Payment: Balance due upon project completion and delivery of clearance documentation

Accepted Payment Methods

  • Check (personal, business, or certified)
  • Bank transfer / ACH
  • Credit card (processing fees may apply)
  • Wire transfer (for larger projects)
Late Payment

Payments not received within 15 days of the due date may be subject to a late fee of 1.5% per month (18% annually). We reserve the right to suspend work on ongoing projects if payments are significantly overdue. Accounts more than 60 days past due may be referred to collections.

Scope of Work

The scope of work for each project is defined in the written contract or proposal. Please note:

  • Defined Scope: Our services are limited to the specific work described in the signed contract
  • Change Orders: Any work beyond the original scope requires a written change order and may result in additional charges
  • Related Repairs: Unless specifically included, we do not perform general construction, painting, or finish work following abatement
  • Testing: Initial testing and clearance testing are coordinated but performed by independent third parties

What Is NOT Included (Unless Specified)

  • Initial lead or asbestos testing/inspection
  • Permits and permit fees (typically passed through at cost)
  • Repairs to areas disturbed during abatement (drywall, trim, etc.)
  • Painting or finishing work
  • Furniture moving or storage
  • HVAC system cleaning

Warranties

AAA Abatement LLC stands behind the quality of our work:

Workmanship Warranty

We warrant that all abatement work will be performed in accordance with applicable federal, state, and local regulations and industry best practices. If our work fails to meet regulatory requirements or pass clearance testing due to our workmanship, we will correct the deficiency at no additional cost.

Warranty Limitations

Our warranty does not cover:

  • Recontamination from sources outside the abated area
  • Damage caused by others after project completion
  • Normal wear and deterioration
  • Conditions not disclosed or not discoverable at the time of work
  • Issues arising from client's failure to follow post-abatement instructions
Disclaimer

EXCEPT AS EXPRESSLY STATED HEREIN, WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Our liability is limited to the remedies expressly set forth in these Terms.

Limitation of Liability

To the fullest extent permitted by law:

  • Direct Damages: Our total liability for any claim arising from our services shall not exceed the amount paid by Client for the specific service giving rise to the claim
  • Indirect Damages: We shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, loss of use, or business interruption
  • Third-Party Claims: We are not liable for claims arising from actions or omissions of third parties, including inspectors, hygienists, or testing laboratories
  • Pre-Existing Conditions: We are not liable for pre-existing conditions at the property not caused by our work

Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. In such jurisdictions, the above limitations may not apply to the extent prohibited by law.

Indemnification

Client agrees to indemnify, defend, and hold harmless AAA Abatement LLC, its owners, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Client's breach of these Terms or any project contract
  • Client's misrepresentation or failure to disclose material information
  • Client's negligence or willful misconduct
  • Claims by third parties related to the Client's property, except to the extent caused by our negligence
  • Client's violation of applicable laws or regulations

Regulatory Compliance

AAA Abatement LLC performs all work in compliance with applicable regulations, including:

  • EPA regulations (40 CFR Part 745 - Lead; 40 CFR Part 61 - Asbestos NESHAP)
  • OSHA regulations (29 CFR 1926.62 - Lead; 29 CFR 1926.1101 - Asbestos)
  • State-specific regulations in MA, CT, NH, and VT
  • Local health department requirements
  • HUD Lead Safe Housing Rule (where applicable)

Client Responsibilities

Client acknowledges responsibility for:

  • Providing accurate information about the property and known hazards
  • Disclosing any previous testing or abatement work
  • Ensuring occupants vacate as required during work
  • Providing access for required inspections
  • Maintaining records as required by applicable regulations

Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of AAA Abatement LLC or its content suppliers and is protected by intellectual property laws.

  • You may not reproduce, distribute, modify, or create derivative works from our content without written permission
  • Our company name, logo, and service marks may not be used without prior written consent
  • Project photographs and documentation may be used by us for marketing and portfolio purposes unless Client objects in writing

Dispute Resolution

We value our client relationships and prefer to resolve disputes amicably. In the event of a disagreement:

Informal Resolution

Before initiating formal proceedings, both parties agree to attempt good-faith negotiations to resolve any dispute. Please contact us directly to discuss any concerns.

Mediation

If informal negotiations fail, both parties agree to participate in non-binding mediation before pursuing litigation. Mediation costs shall be shared equally.

Litigation

If mediation is unsuccessful, either party may pursue their legal remedies. Any legal action must be commenced within one (1) year of the event giving rise to the claim.

Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict of law principles.

Any legal action or proceeding relating to these Terms or our services shall be instituted in the state or federal courts located in Hampden County, Massachusetts. Both parties consent to the exclusive jurisdiction of such courts.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement

These Terms, together with any signed project contract, constitute the entire agreement between you and AAA Abatement LLC regarding the subject matter herein and supersede all prior communications, representations, and agreements.
